Terms of Use and General Terms and Conditions

1. Scope of Application

1.1. These Terms of Use govern the contractual relationship between the Association of Job Seekers (Job Seekers) and the users ("Users") of the Job Seekers' "screeny.today" services (including coaching), in particular the use of the Greenscreen Studio and its equipment. This also includes the documents provided electronically or otherwise in this context ("Training Materials").

1.2. By booking the Greenscreen Studio via the website www.screeny.today ("Website"), the User accepts these Terms of Use and General Terms and Conditions.

2. Booking and Access

2.1. Bookings are made exclusively via the Website.

2.2. Access to the Greenscreen Studio is via the key4friends app. The app is a digital key, and the User receives access to the studio within the booked time.

2.3. The user downloads the app before arriving at the studio so that the digital key is ready.

2.4. If the studio is booked outside of regular office hours, the user will receive the building access code after booking. This code must not be shared with third parties. Access is not possible without this code.

2.5. Using the Gleis70 building access code to gain entry to the building independently of a booking with screeny.today may result in criminal prosecution under Swiss law.

3. Payment Terms

3.1. The usage fee must be paid in advance during the booking process. The advertising agency uses suitable electronic payment methods (e.g., credit card, Klarna, PayPal, Twint).

4. Use of the Green Screen Studio

4.1. The user agrees to use the studio only for the purposes specified on the website and in accordance with the maximum number of people (max. 5 people). If more than 5 people are expected, the advertising agency must be notified in advance. Unauthorized or illegal activities are prohibited.

4.2. The studio must be vacated on time.

4.3. The user acknowledges that the green screen studio and the materials provided by the advertising agency (such as smartphones, teleprompters, Rode microphones, etc.) must be used with respect and utmost care.

4.4. The user agrees to report any damage that occurs during the use of the studio immediately and to be liable for any costs incurred. The user is also specifically liable for damage caused by improper use.

4.5. The user agrees to keep the studio clean and to leave it in the same condition as it was found. Food odors must be avoided. Failure to comply with this rule may result in additional cleaning fees.

4.6. The user agrees to maintain reasonable noise levels while using the studio. Due to the studio's 24/7 availability, it is particularly important to be considerate of surrounding rooms or buildings, especially during the night and early morning hours. In case of violations of this noise restriction, the recruitment agency reserves the right to charge additional fees and/or cancel future bookings by the user.

4.7. The user is obligated to instruct any other persons present in the studio during their use and is responsible for ensuring that these persons comply with these terms of use.

5. Liability and Insurance

5.1. The recruitment agency is liable only for intentional misconduct and gross negligence. All other liability is excluded.

5.2. Use of the studio is at the user's own risk. The recruitment agency is not liable for any losses or damages incurred by the user during the use of the studio, unless these are due to intent or gross negligence on the part of the recruitment agency.

5.3. The recruitment agency cannot be held liable for damages that may arise from the user's careless handling of the electronic access data or during the booking and use of the greenscreen studio and the surrounding premises.

5.4. If booked appointments are not kept by the user or are cancelled due to force majeure, e.g., also in the case of short-term illness or accident of a trainer, no claims can be made against the recruitment agency.

6. Cancellation

6.1. Cancellation of a booking must be made at least 24 hours before the booked time and must be sent by email to go@screeny.today or info@bewerbeagentur.ch.

7. Intellectual Property

7.1. Copyright and all other intellectual property rights to the booked coaching sessions, the know-how imparted in the coaching sessions, and the training materials provided remain with the recruitment agency.

7.2. Unless expressly provided for in these Terms of Use or a separate agreement, the user acquires no rights, titles, or licenses to the coaching sessions, the know-how imparted in the coaching sessions, or the training materials provided.

7.3. The user is granted a non-exclusive and non-transferable right of use for personal purposes. The know-how imparted in the coaching sessions and the training materials provided may not be sublicensed or sold, either in whole or in part. The distribution of the training materials provided is permitted only with the prior written consent of the recruitment agency.

7.4. The user is not permitted to reproduce or publish the provided training materials, in whole or in part, even in edited form, without the prior written consent of the recruitment agency.

7.5. Making image and/or sound recordings during a coaching session without the prior written consent of the recruitment agency or the respective coach is not permitted.

 

8. Data Protection

8.1. The user acknowledges and agrees that the recruitment agency collects, stores, and processes the participant's personal data in connection with providing the green screen studio and related services. The separate data protection declaration on the website (www.bewerbeagentur.ch/datenschutz) applies.

9. Right to Amend

9.1. The recruitment agency reserves the right to amend these terms of use at any time with reasonable prior notice. The terms of use in effect at the time of booking apply.

 

10. Final Provisions

10.1. Should any provision of these Terms of Use be invalid, ineffective, or unenforceable, this shall not affect the validity of the remaining provisions and these Terms of Use.

10.2. The invalid, ineffective, or unenforceable provisions shall be replaced by valid, effective, and enforceable provisions that most closely approximate the economic intent of the invalid provisions.

11. Applicable Law, Jurisdiction

11.1. These Terms of Use and the services provided by the recruitment agency in connection with these Terms of Use are governed exclusively by Swiss law.

11.2. The application of the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980 (“Vienna Sales Convention”) is expressly excluded.

11.3. The ordinary courts at the recruitment agency's registered office shall have exclusive jurisdiction to adjudicate any disputes arising out of or relating to these Terms of Use or the services provided by the recruitment agency in connection therewith. The recruitment agency may, at its discretion, also pursue claims before the ordinary courts at the participant's place of residence.

1.1 The operator of this website is the association BEWERBEAGENTUR (hereinafter: "Bewerbeagentur").

1.2 This privacy policy governs the processing of personal user data ("personal data") by Bewerbeagentur, which is collected when using the website and all subpages under the domain www.screeny.today ("Website") as well as when using the services (namely coaching) provided by Bewerbeagentur.

1.3 As part of our business relationship, you must provide the personal data necessary for establishing and conducting a business relationship and fulfilling the associated contractual obligations. Without this data, we will generally be unable to conclude or process a contract with you. The Website also cannot be used if certain information required to ensure data transmission (such as the IP address) is not disclosed.

3. Data Collected

A. Personal Data

3.1. Personal data is information relating to an identified or identifiable natural person. This includes, for example, first name, last name, company, address, mobile/telephone number, email address, IP address, date of birth, and all data that you (or a person appointed on your behalf) provide to the application agency when registering or booking for the Greenscreen Studio and/or coaching and/or making an inquiry via email or telephone, or which is automatically collected by cookies, Google Analytics, or similar services when you visit the website.

B. Cookies

3.2. We use cookies for the statistical analysis of our website. Cookies are files that can be stored on your computer's hard drive. They help us to tailor our website precisely to your needs. 3.3. bewerbeagentur uses Google Analytics on its website. This is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, google.com, which allows bewerbeagentur to measure and analyze website usage (in a non-personally identifiable way). Cookies are also used for this purpose, which are set by the service provider. 3.5. For your registration and the processing of all administrative matters, we require the following data from you in particular: first and last name, address, telephone number, email address, billing address, and payment information.

3.6. All personal data collected via the website screeny.today of bewerbeagentur may be combined with data about the same person.
